ICX Media, Inc., and its related companies (collectively “ICX,” “we,” “our”), collects, uses, and shares a range of information in order to provide actionable insights to our customers. This helps our customers identify audiences, tailor content to an audience’s interests.

This Privacy Policy provides you with information about the information and other data ICX collects, how and why we collect it, and how we use and share it to provide services to our customers. If you are a resident of the State of California, this Privacy Policy also provides additional information on your rights and choices under California law.

Information We Collect and How We Collect It

We collect information from popular social media platforms via application programming interfaces (APIs) and similar tools that facilitate data collection on those platforms. Most of this data includes information that users make public on those platforms, for example, the content users post and share, user comments on content posted by others, and the brands or personalities that users follow. In some instances, we may supplement this data with additional data provided by third parties. We may then analyze this information to understand users’ interests or other things about them. Some of this data may constitute “personal information” under applicable privacy or data protection laws. The information that we collect falls into different categories, for example:

    • Identifiers, such as name, username, screen name, email address, physical address, social network identifier, and other similar identifiers.
    • Commercial information, including information about products or services users have obtained, or user purchasing or consuming histories or tendencies (if users share such information in public posts or comments).
    • Internet or other electronic network activity information, including information about the platforms users use, videos viewed, channels subscribed to, and links that users share with other users.
    • Audio, visual, and similar information, such as links to content that users create, post, share, or view, user profile pictures, and other similar audio or visual information.
    • Approximate location information, for example, city, state, or zip code (if a user includes that information in a profile or post). (Note that ICX does not collect precise location information.)
    • Demographic information as inferred from user profiles, comments, and posts, for example gender, ethnicity, household income, and approximate age.
    • Inferences, including inferences about users’ interests, product preferences and brand affinities, political affiliation, and other inferences.
    • Other information that users may include in public posts, comments, pages, and content.

How We Use the Information We Collect

We use the information we collect for a number of business and commercial purposes, including to:

  • Provide a wide range of products and services to our customers, including, helping our customers to identify, connect with, and communicate effectively with audiences, optimize their digital campaigns and services, find content creators and new talent, and forecast and measure performance, among other things.
  • Help our customers match and enhance the information in their own data sets, and to make those data sets more effective;
  • Provide and improve our own products and services, and to develop new products and services, including through the improvement and optimization of our models and tools;
  • Conduct market, industry, and academic research, including for purposes such as technological development and demonstration;
  • Maintain the quality, safety, and security of our services and the products and services of our customers and others, including by detecting security incidents, and protecting against malicious, deceptive, fraudulent, or illegal activity;
  • Debug or identify and repair errors that may impair the functionality of our systems, tools, products and services; and
  • Market and promote our products and services.

How & Why We Share Information

We share the information we collect with a variety of third parties, such as the following:

  • Our customers and their service providers. We share the information we collect and generate with our customers and their service providers or other vendors in order to provide products and services to them, and to help them develop, build, maintain, and improve their own products and services.
  • Vendors, partners and other service providers. We may share information with vendors and partners who perform functions on our behalf or on behalf of customers, such as hosting and storing data, helping us to improve our systems and models, providing analytics or advertising services to us, and helping us develop new products and services.
  • Market, industry, and academic research partners.
  • Our subsidiaries and affiliates. We may share information with ICX affiliates and subsidiaries for use for any of the purposes described in this Privacy Policy.
  • Business transfers. We may share information in connection with a proposed or consummated sale or transfer of all or a part of our business or assets, corporate merger, consolidation, or bankruptcy.
  • To protect important interests, enforce legal rights and comply with laws. We may share information with law enforcement, regulatory agencies and authorities, courts, emergency services, parties in litigation, or other third parties for legal, protection, security, and safety purposes, when we believe in good faith that disclosing this information is required by law, or otherwise necessary or advisable. Examples include:
    • Complying with laws or regulatory requirements and to respond to lawful requests and legal process;
    • Protecting our rights and property, as well as those of our agents, partners, customers, and others, including enforcing our agreements and policies, and protecting our network and physical assets; and,
    • Protecting the safety of our employees and agents, our customers, or any other person.

Information We Collect, Use, and Disclose

Please see the “Information We Collect and How We Collect It,” “How We Use the Information We Collect,” and “How and Why We Share Information” sections above for a description of the categories of personal information we collect and how we use them, the categories of sources from which we collect such information, and the third parties with whom we share such information.  In the past 12 months, we have sold or disclosed for commercial and business purposes the following types of personal information to our customers and their service providers:

  • Identifiers;
  • Commercial information;
  • Internet or other electronic network activity information;
  • Audio, visual, and similar information;
  • Approximate location information;
  • Demographic information;
  • Inferences; and
  • Other information that users may include in public posts, comments, pages, and content.

Do Not Sell My Personal Information

Some of our disclosures of information to third parties may constitute “sales” under the broad definition of that term under the California Consumer Privacy Act (“CCPA”). If you are a California resident, you may have the right to opt out of any disclosure or sharing of your personal information in a way that is deemed a “sale” under the CCPA. When you exercise your right to opt out, we will no longer share the personal information that you identify to us in a manner that constitutes a sale.

Please note that, because many individuals share the same or similar names, ICX can only determine whether it has collected information about you if you provide a social media username, screen name, or email address that uniquely identifies you on a particular social media account or platform. If you wish to opt-out of the sale of your personal information related to more than one social media account or platform, you will need to submit a unique identifier for each relevant account or platform. Please refer to the specific instructions in the webform described above. Access and Deletion

If you are a California resident, you may also have the following rights with respect to any information about you that constitutes “personal information” under the CCPA:

  • Make an access request, regarding the personal information we have collected about you;
  • Request deletion of your personal information; and
  • Obtain additional details regarding our information practices, including how we have collected and shared personal information; and
  • The right not to be discriminated against for exercising your rights under the CCPA.

Please note that ICX can only determine whether it has collected information about you, and can only respond to your request, if you provide a social media username, screen name, or email address that uniquely identifies you on a particular social media account or platform. If you wish to request any of the rights above for more than one social media account or platform, you will need to submit a unique identifier for each relevant account or platform. Please note that ICX may need to obtain additional information from you in order to verify your identity and respond appropriately to your request. Designating an authorized agent to make requests on your behalf

If you wish to designate an authorized agent to make requests on your behalf, you can do so by providing a written authorization that:

  1. States the full legal name of the individual you have selected as your authorized agent;
  2. Clearly states which rights you wish to exercise;
  3. Identifies the relevant social media username(s), screen name(s), email address(es), or similar identifier(s) (as described above) for the rights you wish to exercise; and
  4. Is signed and notarized in accordance with applicable requirements under California law.
Please note that we may require your authorized agent to verify their own identity directly with us, by supplying a copy of a driver’s license, passport, or other official government document that matches the full legal name of the individual identified in your written authorization.

Children and Teens

ICX does not knowingly collect personal information from consumers under age 16 and does not sell the personal information of any individual that that it knows is under 16.
